How to Draft a Contract
If you are entering into a business relationship with another party, and you have any hesitation that your agreement is unclear or you’re not sure what the agreement is, go ahead and put the agreement in writing in a simple contract. Follow the steps below.
Identify the parties to the agreement stating who is entering into the contract.
State in plain language what type of agreement the parties are entering into. (e.g., Jack is building a new roof on Jill’s house located at 123 Mulberry Lane).
State in plain language what is required of each party and when. For example, one party may be performing a certain service, while the other may be agreeing to pay a certain amount of money.
If there are any contingencies to your arrangement or uncertainties, attempt to detail those as much as possible in plain, understandable language and how the parties would handle each situation.
Each party should sign and date the contract.
