The art of negotiating or negotiation of a settlement is an important skill in all disputes or in lawsuits. Follow the basic steps below to learn how to negotiate a settlement effectively.

If you are seeking recovery of money or you desire something to happen to resolve a dispute or lawsuit, use multiple bargaining chips by asking for an amount higher than you really want either in additional dollars or other things you want to occur.

By asking for more than your true settling point, it will provide “bargaining chips” for you to concede and pull off the table as you go back and forth with the other side.

If you use “bargaining chips,” you will have a greater chance of meeting in the middle and potentially reaching a settlement that is what you truly desire to resolve the dispute or suit.

You cannot “opt out of the game” in negotiations. In other words, you cannot just say, “let’s just cut to the chase, and here’s what I’m really asking for.” The other side will be playing the negotiations game and assume you are doing the same. If you “opt out of the game,” you will be forced to make concessions on what you are really asking for, which will result in a less favorable settlement for you. If you use bargaining chips, you can meet in the middle closer to the outcome you truly desire.
